Fono User Agreement

Effective Date: February 7, 2025

Welcome to Fono! By using the Fono app (the “App”), you agree to be bound by the terms and conditions outlined in this User Agreement (the “Agreement”). Please read this Agreement carefully before using the App.

1. Acceptance of Terms

By downloading, accessing, or using the Fono app, you agree to comply with this Agreement. If you do not agree with any part of this Agreement, you must not use the App.

2. Eligibility

You must be at least 17 years old to use the App. If you are under 17 years of age, you are prohibited from using the App. By using the App, you affirm that you are 17 years of age or older.

3. Location and Jurisdiction

Fono is based in California, USA. By using the App, you agree that any legal action or proceeding related to this Agreement shall be brought exclusively in the courts located within California, and you consent to the jurisdiction of those courts.

4. User Account

In order to use certain features of the App, you may need to create a user account. You agree to provide accurate, current, and complete information during the registration process and to update your information as necessary. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.

5. Restrictions on Use

You agree to use the App only for lawful purposes and in accordance with this Agreement. You may not:

• Use the App in any way that violates any applicable local, state, or federal law.
• Engage in any activity that harms, disrupts, or interferes with the App or its services.
• Attempt to gain unauthorized access to any part of the App, other users’ accounts, or any associated systems or networks.
• Use the App to send unsolicited advertisements, spam, or other communications.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which can be found in the App or on our website. Please review the Privacy Policy to understand how we collect, use, and protect your personal data.

7. Intellectual Property

All content, features, and functionality available through the App, including but not limited to text, graphics, logos, and software, are the property of Fono or its licensors and are protected by copyright, trademark, and other intellectual property laws.

8. Disclaimers and Limitations of Liability

The App is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability or fitness for a particular purpose. Fono does not guarantee that the App will be uninterrupted or error-free.

Fono is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.

9. Termination

Fono reserves the right to suspend or terminate your access to the App at any time, without notice, for conduct that violates this Agreement or is otherwise harmful to other users or the App.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
